These Website Terms of Use ("Terms") are a binding agreement between you and Skyship Services, Inc. ("Skyship Services," "we," "us" or "our") governing your access to and use of skyshipservices.com and our related web properties (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Skyship Services is registered with the U.S. Department of State Directorate of Defense Trade Controls. Information on this Site is public release material only and is not, and must not be treated as, technical data subject to the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR).
Do not transmit classified information, controlled unclassified information (CUI), or export-controlled technical data through this Site or its forms. Where a discussion requires controlled information, contact us and we will establish an appropriate channel. You are responsible for complying with all applicable export control laws in connection with any information you send us or receive from us.
The Site is intended for businesses, government agencies and individuals at least 18 years old. If you use the Site on behalf of an organization, you represent that you have authority to bind it to these Terms.
We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site for informational purposes and to evaluate or procure our capabilities. You will not:

Third-party and government material. Agency names, program names and any imagery attributable to a U.S. Government source are used for identification and descriptive purposes only. Their appearance does not imply endorsement by any agency or department, nor any affiliation beyond the contracts and programs described.
You represent that information you submit is accurate and that you have the right to provide it. We handle personal information as described in our Privacy Policy. Do not send confidential, proprietary, classified or export-controlled information through the Site's public forms. Any unsolicited ideas, suggestions or feedback will be treated as non-confidential, and you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
The Site is informational. Nothing on it — including descriptions of platforms, specifications, availability, capability or past performance — is an offer, a guarantee, or a commitment to provide any system or service. Submitting an inquiry does not create a contract or a teaming relationship. Any engagement is governed solely by a separate written agreement or a properly executed government contract, which controls over the Site in the event of conflict.
Platform specifications, coverage figures, availability rates and program values shown on the Site are nominal, describe particular configurations or historical programs, and are subject to change. They are provided for general information and are not a warranty or a guarantee of performance under any specific operating condition. Actual performance depends on configuration, payload, environment, airspace authorization and other factors.
We work to keep the Site accurate and current, but we do not warrant that it is complete or error-free, and we may change or discontinue any part of it at any time without notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, SKYSHIP SERVICES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Skyship Services and its officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
These Terms and any dispute arising out of them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any such dispute is the state or federal courts located in Orange County, Florida, and you consent to their personal jurisdiction. Nothing in this section limits any right or remedy of the United States Government.
We may update these Terms. When we do, we will revise the "Last updated" date above. Continued use of the Site after an update means you accept the revised Terms.
If any provision is found unenforceable, it will be limited or severed and the remainder will stay in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement regarding the Site. You may not assign them without our written consent.
